During presentation of evidence of the above-entitled case, direct examination was conducted by the Trial Prosecutor to the witness who was in the witness stand. The witness was then directed to identify the accused and to inform the Honorable Court if the accused was inside the courtroom.
Trial Prosecutor: Ms. witness, will you please inform this Honorable Court if the accused is inside the courtroom.
Witness: Yes, your Honor, the accused is here. (Pinpointing a man sitting in a chair on the other side.)
Trial Prosecutor: Since you were telling that the accused is inside the courtroom, will you please inform this Honorable Court how did you know the accused and why did you file a case of Rape against him?
Witness: I do not know him, your Honor. All I know is that he is the person who raped me, that's why I filed a case for Rape against him.
Trial Prosecutor: Ms. Witness, do you have any proof of evidence to prove that the accused is the man who have actually raped you?
Witness: Yes, Your Honor, I have and I am certain of it.
Trial Prosecutor: Okay. By telling this Honorable Court that you have an evidence to prove that would warrant the accused' conviction, please present your evidence.
Witness: Yes, Your Honor, I will.
In order for the witness to establish the proof of evidence against the accused, the witness requested the Honorable Court to let the accused stand up and to strip inside the courtroom.
Since stripping is necessary in order for the witness to identify and to prove that the accused was actually the man who raped her, the witness' request was granted and the accused was then directed to stand in front of the courtroom to strip.
So, the accused was then directed to remove his clothes including his underwear. The accused was totally naked while standing in front of the people inside the courtroom. While standing naked, the people inside the courtroom as well as the Trial Prosecutor saw and noticed that the sexual organ of the accused was painted with different colors.
Trial Prosecutor: Ms. Witness, the accused is now naked, what proof of evidence would you like to present?
Witness: Your Honor, there is.
Trial Prosecutor: What is that? Present it now.
Witness: Yes, Your Honor, there is. An Eagle. The eagle is there. I can see it.
Trial Prosecutor: What eagle are you talking about? I could not see an eagle here. Look for that eagle and present it now.
Witness: Yes, Your Honor, I will.
In order for the witness to prove that the eagle was there, she requested the Honorable Court to let her stand and go to the accused. Her request was granted. So, she stood up from the witness stand and went directly to the accused, holding his sexual organ then said:
Your Honor, here is the eagle. (Looking at the sexual organ of the accused.) I am holding it now. I caught the Eagle.
So, the Trial Prosecutor went near to the accused where the witness was holding the accused' sexual organ. He then saw that the different colors printed in the sexual organ of the accused were tattoos designed with a bird.
Trial Prosecutor: Ms. Witness, I could not see an eagle here. All I can see is a Maya in his glans penis. (Maya is a small, domestic rice-picking bird.)
